13-year-old found guilty of sexual assault on 12-year-old in Alberta classroom

Court heard that the incident occurred in a darkened computer classroom after the teacher had left the room.

A youth was found guilty of sexual assault on July 3 in Westlock Court of Justice.

A youth has been found guilty Wednesday in Westlock Court of Justice of sexual assault against a fellow student in a Westlock classroom.

The youth, who can't be identified due to the Youth Criminal Justice Act, is expected to be sentenced in October after a pre-sentence report has been completed. 

Court heard that the incident occurred in a darkened computer classroom after the teacher had left the room on April 5, 2023. 

The youth was 13 at the time and the victim was 12. 

Justice Thomas Achtymichuk said he didn't believe the youth when he had claimed that he had accidentally touched the girl's thighs and groped her genitals. The youth said the teacher had asked him to help the student and his hand "slipped." 

The victim testified that she kept pushing his hand away from her and telling him not to touch her but he had persisted.

There is a publication ban on identifying the girl.
